The Applicant herein is challenging the order passed by the Additional Sessions Judge, Pune dated 27th September, 2017 thereby allowing the application filed by the prosecution under section 439 (2) of the Criminal Procedure Code, 1973.

It appears that the Applicant herein was arrested in Crime No. 248 of 2017 for offences punishable under section 302, 307, 143, 147, 148, 149 of the Indian Penal Code and section 4 r/w. 25 of the Indian Arms Act. 3.
The Applicant herein was enlarged on bail vide order dated 4.4.2015 and V.A. Tikam 1/2
the Applicant was directed to attend the police station. The Applicant had attended the police station only till 19th of October, 2015 and, thereafter, his whereabouts were not known.

It is pertinent to note that in September, 2017, the accused was found indulging in the case of Arms Act for possessing the pistol without license. It appears that the charges were framed. However, the trial was protracted since the Applicant was not available and secondly, the other co-accused had filed application seeking exemption. No such application was filed by the present Applicant.

It is in these circumstances, the Learned Sessions Court has, by a well reasoned order, allowed the application filed by the prosecution. The Applicant does not deserve to be enlarged on bail as he has committed the breach of the bail conditions. However, the Learned Sessions Court, Pune seized with Sessions Case No. 24 of 2015 shall make every endeavor to expedite the trial as far as possible.
Application stands disposed of.
