Heard learned counsel for the parties.

By this civil application, the applicant is seeking to carry out amendment in cause title of Family Court Appeal No. 62 of 2009 deleting the name of appellant no.2 Smt. Yasmeen Wd/of late Hamid Jugari who died on 8th August, 2017. Learned counsel Mr Mohit appearing on behalf of the respondent wife submits that they have no objection if the civil application is allowed.

904-cam-246-18.doc counsel for the applicants and the averments made in the civil application, we are satisfied that the applicant has made out a case for allowing the civil application. Hence, the following order:- a) The applicant is permitted to carry out appropriate amendment by deleting the name of applicant No.2 Smt. Yasmeen Wd/of late Hamid Jugari from the cause title of Family Court Appeal No. 62 of 2009 as well as the pending civil application within three weeks from today. b) Amended copy be served on the other side within the said period.
