This is an application seeking condonation of delay in filing the second appeal. The delay is of 94 days. It appears that the applicant herein had approached the Legal Aid Department and accordingly the learned counsel Mr. Raut is assigned the matter. 2.

In view of this, the delay of 94 days deserves to be condoned in the interest of justice. The learned counsel for the respondent submits that there is no plausible explanation for the inordinate delay in filing the present appeal. However, the very fact that the appeal is being filed through Legal Aid Department, the Court could not expect any specific reason to be assigned. Hence, the delay of 94 days deserves to be condoned in the interest of justice. varsha
