The petitioner had filed an application seeking right of residence at Vadodara. The respondent/husband showed his willingness to provide accommodation at Vadodara. The petitioner is now seeking accommodation/alternative accommodation/ expenses for residence in Mumbai.

Such request has been made for the first time before this Court. Therefore, it is necessary for the petitioner to file an appropriate application seeking accommodation in Mumbai before the Family Court.

If such an application is filed by the wife before the learned Family Court, the learned Family Court shall decide such application within six (6) weeks from the date of filing of such

19-wp6343-2021.doc application after giving opportunity to the husband to file reply affidavit and after giving opportunity of hearing to both the sides. 4.

With the said liberty, the writ petition stands disposed of in above terms. No costs.
