At the outset, the learned APP submits that during the pendency of this application, charge has been framed against the accused and the trial has commenced.

The witness summons were already issued. On the last date before the Sessions Court, the learned counsel appearing for the accused had sought an adjournment and, therefore, the next scheduled date in the trial is 5.12.2016. In view of this, the learned counsel for the applicant fairly submits that the trial may be expedited.

Taking into consideration the fact that the trial has commenced, the application deserves to be disposed of without going into the merits of the matter. Hence, the learned Sessions Judge is requested to make an endeavour to conclude the recording of evidence, as far as possible, within one year from the date of receipt of this order. Application stands disposed of.
