When the matter was called on 5th January, 2018, none appeared for the Petitioner and the matter was directed to be kept for dismissal today.

Today, Mr Malelwar, learned advocate appears for the Petitioner and seeks further time to take instructions. Perusal of the Petition reveals that the Petitioner seeks quashing and setting aside of the appointment made in Pg 1 of 2

906.wp.8462.2014.doc pursuance of the advertisements dated 15th December, 2010; 20th May, 2012 and 11th December, 2011.

Almost for a period more than three years no steps are taken by the Petitioner seeking any order. In any event the persons whose appointments are sought to be set aside are not impleaded as a party Respondent in this Petition. In that view of the matter, we find that the Petition apart from delay and latches also suffer from non - joinder of necessary parties. The Petition is without merits and stand dismissed. No costs.
