Heard the learned Counsel for the applicant and the learned APP for State. Peruse papers.

This is an application under Section 439 of the Code of Criminal Procedure, 1973. The applicant herein is an accused in Sessions Case No. 134 of 2013 pending before the Sessions Judge at Kalyan. The applicant is facing the charges under Section 363, 366 and 376 of the Talwalkar 1/2

19.ba1374.15.sxw Indian Penal Code. The prosecution has examined the complainant and her mother. The trial is in progress. At the time of the incident, the victim was hardly 12 years old. Since the trial is in progress, enlarging the applicant on bail would cause prejudice to the prosecution and possibility of tampering with other evidence cannot be ruled out. Hence, the application being sans merits stands rejected.
