Heard learned counsel for the parties.

By this application, the Applicant seeks quashing and setting aside of the order dated 15th June, 2019, passed by the learned Additional Sessions Judge, City Civil and Sessions Court, Greater Mumbai, inasmuch as, it directs the applicant to deposit an amount of Rs.7,63,500/-, within a period of 10 days, in the Registry of the trial Court. 3.
Learned Counsel for the applicant has tendered an affidavitcum-undertaking of the applicant. The same is taken on record and marked

In the said an affidavit-cum-undertaking, the applicant has undertaken to deposit 50% of Rs.7,63,500/- i.e. Rs.3,81,750/- in the Court of the learned Metropolitan Magistrate, 2nd Court at Sewree, Mumbai, within four weeks from today and the balance 50% within 12 weeks from today i.e. within eight weeks from the first deposit. The applicant is ready to deposit the aforesaid amount, without prejudice to his rights and contentions and without admitting his liability. The applicant to abide by the undertaking and deposit the amounts as stated herein-above. 4.
In view of the affidavit-cum-undertaking given by the applicant, nothing survives for consideration in this application. 5.
Application is accordingly disposed of.
