1] This is an application under section 439 of the Code of Criminal Procedure for bail in CR No. 291 of 2017 dated 29.12.2017 registered with N.M. Marg Police Station, Mumbai under sections 304, 338, 337 read with 34 of the Indian Penal Code.

2] Heard the learned counsel for the applicant and the learned Special P.P. Perused the record.

3] The learned counsel for the applicant submitted that, the coaccused Rajendra Patil who has been assigned with same and/or similar role as that of applicant, has been released on bail by this Court by its 1/3

Order dated 28th June 2018 and therefore the applicant be also released on bail on the ground of parity. The learned Special P.P fairly conceded to the said fact.

4] After perusing the entire record, it appears that, the role assigned to the present applicant is same and/or similar to that of coaccused Rajendra Patil and therefore the applicant is entitled to be released on bail on the ground of parity.

5] In view of the above, the applicant can be released on bail. Hence, the following Order:- (a) The applicant shall be released on bail in CR No.291 of 2017 dated 29.12.2017 registered with N.M. Joshi Marg Police Station, Mumbai now culminated into Sessions Case No.209 of 2018 pending on the file of Additional Sessions Judge, Greater Mumbai, Mumbai on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.

(b) After his release from jail, the applicant shall attend the N.M. Marg Police Station, Mumbai on every first Monday of the month between 11.00 a.m to 1.00 p.m (c) The applicant shall attend all the dates before the Trial Court 2/3

unless precluded for medical reasons.

(d) The applicant shall not tamper with the evidence and/or pressurize the prosecution witness.
