After arguing for some time, when this Court was not inclined Ms. Kabare, learned counsel appearing for the Petitioners submits that an appropriate Application for amendment of the written statement will be made to incorporate a defence on the ground of limitation. If such an Application is made, the trial Court to consider the same on its own merits and in accordance with law. 2.

In view of the said submission nothing further survives for consideration in the Petition.
