DATED : 25th MARCH, 2022 P.C:- The present Application is moved in the wake of subsequent events being, that the co-accused Ramchandra Parte was released on bail by this Court on 2/7/2021 (Bail Application No.1040/2020). On an earlier occasion, on perusal of the merits of the case, I have expressed my disinclination to entertain the application which prompted the applicant to withdraw the Application.

In the backdrop of the order dated 2/7/2021 which is projected as subsequent event, the learned APP was directed to seek instructions about the claim of parity and the affidavit is filed Tilak

2/2 1 BA 2970-21.doc by the EOW, which clearly distinguish the role of the present applicant who was directly involved in the offence as against the co-accused Ramchandra Parte, who was clearly recorded not to have been indulged in any transaction was the complaint and has been merely working as an agent.

Being confronted in the distinct roles attributed to these two accused, the learned counsel for the applicant seek permission to withdraw the application.
