By an interim order, while admitting the petition by order dated 13th April, 1999 this Court was pleased to direct Respondent No. 6 - State of Maharashtra to pay the Petitioner Firm ad-hoc compensation @ Rs. 70/- per sq. mtr. Thereafter it appears that possession of the land was given by Maharashtra Jivan Pradhikaran to the Municipal Corporation. The Corporation has now constructed a 1 / 2

WP. 1569-99 fertiliser plant on the said land. In our view, petition, can be disposed of in terms of the interim order passed by this Court dated 13th April, 1999. A tripartite agreement shall have to be executed, and the Petitioner, the Maharashtra Jivan Pradhikaran and the Thane Municipal Corporation shall have to sign the said agreement. The undertaking given by the Petitioner to this Court, when the interim order was passed, does not survive.
