Heard Mr. Sachin B. Thorat, learned counsel for the applicant and Mr. Ganesh T. Jadahv, learned counsel for the respondent.

Learned counsel appearing for the parties submit that they have entered into Consent Terms during mediation proceedings held by Chief Judicial Magistrate, Thane. These Consent Terms are signed by parties and their Advocates. Learned counsel appearing for the parties state that the parties are present in the Court and they identify them. Parties admit and confirm the correctness of the Consent Terms.

Learned counsel appearing for the parties further state that they will file these Consent Terms in H.M.P.No.147 of 2013 pending in the Court of Civil Judge, Senior Division, Karad, Dist.Satara, on or before 15.6.2015.

Mr. Jadhav, upon taking instructions from the respondent who is present in the Court, states that on or before 15.6.2015

2 / 3 MCA/168/2014 the respondent will deposit amount of Rs.2,00,000/- (Two Lakhs) in the Court of Civil Judge, Sr.Dn., Karad under due intimation in writing to the learned counsel for the applicant. He further states that the respondent will go on paying maintenance for their son Omkar, aged about 7 years, at the rate of Rs.3000/- per month, instead of Rs.4000/- per month as per the order dated 26.3.2015 passed by the learned J.M.F.C., Thane in Misc. Application No.172 of 2013 till the son attains majority.

In view thereof, Application is disposed of in the following terms:

(i) Parties shall file Consent Terms dated 29.1.2014 on or before 15.6.2015 before the learned Civil Judge, Sr.Dn., Karad. The respondent shall deposit Rs.2,00,000/- (Two Lakhs) in that Court under due intimation to the learned counsel appearing for the applicant on or before 15.6.2015.

(ii) The respondent shall also go on paying maintenance to their son Omkar at the rate of Rs.3000/- per month instead of Rs.4000/- per month till he attains majority as per the order dated 26.3.2014 passed by Judicial Magistrate First Class, Thane in Misc. Application No.172 of 2013. Amount of Rs.3000/- shall be paid on or before 10th day of the next succeeding month. Learned Judge will pass appropriate orders on the Consent Terms. (iii) Learned trial Judge will pass appropriate orders on the Consent Terms. The learned trial Judge will also simultaneously pass orders for payment of Rs.2,00,000/- (Two Lakhs) to the

3 / 3 MCA/168/2014 applicant herein in terms of the Consent Terms. (iv) In view thereof, this Application does not survive and the same is disposed of accordingly.
