Satish Khemant Shelkande v. State Of Maharashtra
IN THE HIGH COURT OF JUDICATURE AT BOMBAY CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 2775 OF 2014 Satish Khemant Shelkande.
..Petitioner.
Versus
State of Maharashtra.
..Respondent.
Mr. Samir A. Vaidya for the Petitioner.
Mrs. P. H. Kantharia, learned APP for the State. Coram : RANJIT MORE & SMT. ANUJA PRABHUDESSAI, JJ.
Date : January 15, 2015.
P. C. :
1.
The Petitioner has approached this Court under Article 226 of the Constitution of India, seeking to quash the proceedings of Sessions Case No.199 of 2014 pending on the file of learned Sessions Judge, City Civil & Sessions Court, Greater Bombay.
2.
We find that the Petitioner could have approached the trial Court for discharge, however, he did not apply for the same and during the pendency of this petition, charges have been framed. The Petitioner makes a grievance that charges are framed without hearing him. If that be so, the Petitioner is patilsr 1 / 2
at liberty to challenge the same before appropriate Court. We do not see any reason to entertain this writ petition at such a belated stage. Hence, it is dismissed. All points and contentions of the respective parties are kept open. [SMT. ANUJA PRABHUDESSAI, J.] [RANJIT MORE, J.] patilsr 2 / 2
