Mr. Shaikh, learned counsel for the Revision Applicant, fairely concedes that, this Revision Application was preferred against the order passed by the 22nd Joint Civil Judge, Junior Division, Pune, below application "Exhibit-40" on 15th April 2017 in Regular Civil Suit No.4439 of 2012. The said application at "Exhibit-40" was for recalling the order of "No Cross-Examination" and the Trial Court has rejected the said application, subject to payment of costs of Rs.2,000/-. It is submitted that, now pending this Revision Application, the cross-examination is already started and it is on the verge of conclusion. 2.
