Heard learned Counsel for the applicant. Perused the application and the impugned order dated 27th February, 2018 passed by the Registrar Judicial -II. Learned Counsel for the applicant submits that due to unavoidable circumstances the compliance could not be done within stipulated period, which resulted into refusal of registration of the proceeding. Learned Counsel requested to get the proceeding restored at its original stage. The applicant-insurance company is ready to serve notice to the respondents through paper publication within stipulated period.

In view of submissions and the reasons mentioned in the application, there is no impediment to nod in favour of applicant. 3.
Accordingly, civil application stands allowed in terms of prayer clauses (a) and (b). The impugned order passed by the learned Registrar Judicial-II is hereby recalled. The delay caused for filing the present application is also condoned. The proceeding of First Appeal stamp No. 21099 of 2015 with Civil Application No. 1826 of 2016 be restored at its original stage. 4.
The Registry to take requisite steps for further process for publication of notice to respondents, returnable on 12th September, 2018.
