In terms of the order dated 23rd September, 2005, the respondents were required to deposit the entire amount of pension in the trial Court and half of the amount was required to be paid to the appellant. The arrangement was to continue pending the decision of the second appeal. It is urged that the amount was not so deposited by the respondents. It is now undisputed position that the respondents have paid the amount to the appellant, though belatedly and hence, the order passed by this Court has been complied with. In view of this, I do not find that any case

cp400.12.odt is made out for taking action against the respondents.

The contempt petition is dismissed.

The learned counsel for the appellant urged that the respondents are trying to recover some amount from the appellant on the ground that it was paid in excess. If the appellant has any grievance in respect of that, she is at liberty to make appropriate application in that respect. (R.K.DESHPANDE, J.) Rvjalit
