The above Writ Petition has been filed inter alia for issuance of directions, that the Respondent No.1 i.e. Security Guards Board for Greater Mumbai and Thane District be directed to register the Security Guards listed at Exhibit A to the Petition. The second relief is for initiating action against the Respondent No.2 as per the provisions of clause 42 of the Security Guards Scheme 2002 and the third relief is directing the Respondent No.2 to get itself registered with the Respondent No.1 Board.
In so far as the first relief is concerned, it is for the Respondent No.1 to take appropriate action in that regard. mmj
wp-9332-18(45).doc In so far as the second relief is concerned, it is for the Respondent No.1 to arrive at a satisfaction whether action is required to be taken against the Respondent No.2 under the provisions of the Act and the Scheme. In so far as last relief is concerned, it is for the Respondent No.2 to apply to the Respondent No.1 Board for registration. In the event no such application is received from the Respondent No.2 then the logical corollary to the same would be that the Respondent No.1 be susceptible to action under the provisions of the Act and the Scheme. We express no opinion in that regard.
With the observations as aforesaid, the above Writ Petition is accordingly disposed of.
