The second bail application pleads two grounds i.e. passage of time and the claim of parity, pursuant to accused Nos.3 and 4 being released on bail, which came to be rejected by the Sessions Court, Baramati, by order dated 05/07/2021.

Both the said grounds fail to impress me since the passage of time cannot be considered as change in the circumstances and as far as the co-accused being released on bail is concerned, when the applicant has approached the Sessions Court with the said plea, AJN

2/2 50 BA-3057.21.odt learned Judge by recording that the role attributed to the applicant is that of the kingpin of the crime, rejected his application and denied parity.

I do not think this as a fit case to interfere with the said order and consider the same as a change in the circumstance, convincing me to rehear the application once rejected on not being convinced on merits.

The application is rejected.
