In the wake of the settlement effected between the parties, the first appeal is taken up on production board. 2.

Respondent No.1 i.e. the original claimant is present in the court and his identity is established by the Court Sheristedar from his Aadhar card, copy of which, is placed on record. AJN

The first appeal is filed by the Insurance Company being aggrieved by the compensation awarded by the learned Commissioner for Workmen Compensation Act and the Judge, Labour Court, Thane, in W.C.A. No.388/C-71 of 2013. 4.

In furtherance of the said award, the appellant deposited an amount of Rs.14,66,327/- before the learned Commissioner, Thane. The settlement between the parties is to the effect that respondent No.1 is held entitled to an amount of Rs.13,66,327/-, out of the deposited amount towards full and final settlement. The remaining amount shall be permitted to be appropriated by the appellant. The consent terms are taken on record and marked 'X' for identification.

The terms of settlement record that respondent No.1 shall not claim any monies or file any suit or proceedings or any litigation against the appellant in respect of the compensation, which is the subject matter of Application W.C.A. No.388/C-71 of 2013.

The appeal stands disposed of in the wake of the consent terms.
