By this petition, the Petitioner challenges order dated 23 August 2004 passed by the Minister (Home) rejecting Petitioner's Appeal against the order passed by the District Collector, Solapur on 10 August 2003 cancelling his license for operation of a dance bar. 2.

The learned counsel for the Petitioner would submit that though grant of a fresh license to operate dance bar may not be possible now, Petitioner intends to apply for issuance of a license for running an Orchestra inside his Restaurant. The Petitioner would be at liberty to file such an application. If an application for operation of Orchestra inside Petitioner's Restaurant is filed, the same be decided without being influenced by the orders impugned in the present petition. Similarly, Petitioner's deposit in respect of the earlier license may be considered for the purpose of fresh license, if issued in his favour.
