This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.205 of 2021 registered at Talegaon Dabhade Police Station for the ofences punishable under Sections 302 and 201 read with 34 of the Indian Penal Code.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The deceased was the mother of the present applicant. According to the prosecution, on the day of incident which took place on 21 May 2021, a quarrel took place between the deceased and the wife of the present applicant, i.e., daughter-in-law of the deceased, who is co-accused in the present crime. During the said quarrel, the deceased alleged to have beaten to the wife of the Dinesh S. Sherla 1/2
916-ba-2126-22.doc applicant and her son. It is alleged that the wife of the applicant thus got annoyed and strangulated the deceased. The allegations against the present applicant are that he had helped his wife in disposing of the dead body.

Thus, the allegations against the present applicant are of causing disappearance of evidence. I am therefore, inclined to release the applicant on bail. In the result, the following order is passed.
O R D E R
A] Bail Application is allowed.
B] The applicant be released on bail in C.R. No. 205 of 2021 registered at Talegaon Dabhade Police Station for the ofences punishable under Sections 302 and 201 read with 34 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
