Heard learned Counsel for the applicants. The applicants seek relaxation of condition No. 2(c) imposed vide order dated 29th June, 2015 by the Additional Sessions Judge, Vasai in Bail Application No. 266 of 2015. The said Clause 2(c) reads as under:
"2(c) Both the applicants to furnish bank guarantee of Rs. 21 Lac each to be furnished before the complainant, Asstt. Commissioner Sales Tax, Mazgaon within one month from their release on bail. The office of sales Tax shall dealt with issue of recovery and inform this court if required necessary."

Learned A.P.P opposed the said prayer. She states that the applicants can file an appropriate application before the learned Sessions SQ Pathan 1/2
appln.434.15.doc Judge and seek relaxation of the aforesaid condition imposed vide order dated 29th June, 2015.

In view of the objection raised, the learned Counsel for the applicants seeks leave to withdraw this application, with liberty to file an appropriate application before the learned Sessions Judge for modification of the said condition.

Accordingly, application is disposed of as withdrawn with liberty as prayed.

If such an application is filed, the learned Judge shall consider the same on its own merits, uninfluenced by the withdrawal of this application.

The interim protection which was granted by this Court vide order dated 30th July, 2015 is continued for a period of three weeks to enable the applicants to approach the trial Court. 7.
