Pursuant to the last order passed by this Court, the Investigation OfÏcer tendered her afÏdavit stating that mail message/wireless message was not received from the wireless center of the Pune Police. She has relied on the communication issued by the PI, administration, Pune city to the Assistant Commissioner of Police, Pune City dated 19/09/2022. 2.

This Court has already expressed in the order that the Court is facing difÏculties in deciding the bail applications as neither the Investigating OfÏcer nor the investigation papers are produced so as to render assistance to learned APP to argue the bail applications.

This Court has already directed the Commissioner of Police, Pune to look into the matter and further directed the Joint Commissioner of Police, Pune to file an afÏdavit as regards the aforesaid instance about absence of Investigation OfÏcer. 4.

Learned APP on instructions from the Investigating OfÏcer submits that the inquiry is already being conducted by the Joint Commissioner of Police and appropriate afÏdavit as regards corrective measures to be taken so as to ensure appropriate assistance to learned APP in the matter in deciding the bail applications shall be placed on record in any case by 30/09/2022. The statement is accepted.
