1) This is an application under section 439 of the Code of Criminal Procedure, 1973 for bail in C.R. No. I-211 of 2016, dated 28/3/2016 registered with Kashmira Police Station, Thane under section 370 of the Indian Penal Code and under section 4, 5 and 6 of the Prevention of Immoral Trafficking Act, 1956.

2) The first information report is lodged by Shri Sachin Gavas, Senior Police Inspector attached to the prevention of Immoral Human Trafficking Cell Thane (Rural). The prosecution case, in nut-shell, is that the applicant was acting as an agent in the vocation of prostitution and was earning her livelihood from the said vocation. That after receipt of the confidential information, the police laid a trap. As per the

2 /3 29-ba-1420-16.doc directions a bogus consumer contacted the applicant. The place of meeting was accordingly decided. The applicant arrived at the spot i.e. Hotel Fountain, Varsova, Mumbai. After receipt of money by the applicant from the customer, the police accosted the applicant and other victim girls. The alleged tainted currency notes were found in the possession of the applicant. In the premise the first information report is lodged. After completion of investigation, the police have submitted the charge-sheet on 27/5/2016.

3) Heard the learned counsel for the applicant, learned APP and also perused the copy of the charge-sheet annexed to the application.

4) It is to be noted here that the victims in their statements dated 28/3/2016 have stated that as they were facing financial crisis they were advised by the applicant to indulge in the vocation of prostitution to which they willingly acceded. They have also stated that they use to get a particular quantum of money and the applicant used to keep certain amount as her commission. It appears from the evidence annexed to the application that the said victims were indulging into said vocation at their own free will.

3 /3 29-ba-1420-16.doc 5) In view of the facts of the present case, the applicant has made out a case for release on bail.

Hence, the following order :- a) The applicant be released on bail in CR No.I-211 of 2016 registered with Kashmira Police Station, Thane on her furnishing P.R. bond of Rs. 25,000/- with one or two solvent local sureties in the like amount; b) After her release from jail, the applicant shall attend the said Police Station, once in a month i.e. on every first Monday of the said month between 11:00 a.m. to 1:00 p.m. till conclusion of the trial; c) The applicant shall also attend all the dates before the trial Court;

d) Any two consecutive defaults in complying with the aforesaid conditions will attract the provisions of cancellation of bail;

e) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses;

g) The application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
