Heard learned Counsel for the parties.
This appeal is preferred by the original respondent no.2 owner of the vehicle challenging the Judgment and Award dated 01.04.2014 passed by the Motor Accident Claim Tribunal, Pune in M.A.C.P. No. 513 of 2009 holding that appellant is liable to pay a sum of Rs.17,11,000/- alongwith 9% interest to the respondents original claimants by way of compensation.
Both the Counsel states that matter is settled out of court. They tendered the Consent Terms dated 08.01.2015. Same is taken on record and marked 'X' for identification.
The learned Counsel for the respondents original claimants submits that the present settlement is in the interest of minor also. To that effect he has placed on record a certificate dated 08.01.2015 as per Sneha Chavan 1/2
909 fa 5-15=.doc provision under Order 32 Rule 7 of the C.P.C. The said certificate is taken on record and marked 'X1' for identification. Both the Counsel states that appellant as well as respondents are present in the court. Their presence is recorded. First Appeal is disposed of in terms of the Consent Terms dated 08.01.2015.
