Heard learned counsel Mr. Maneshinde for the Petitioner, learned additional public prosecutor Mr. KondeDeshmukh for the State-Respondent No.1 and also Respondent No.2 -Chandrakant Pandurang Rane present -in- person. It is submitted by Respondent No.2-Mr.Chandrakant P. Rane that now there is no dispute between him on one hand and the petitioner and other accused - Mr. Sudhir Malhotra on the other hand. Mr.Sudhir Malhotra is not a party to the present proceeding but he is accused no.1 before the trial court. He is present along with the petitioner. They state that Borey 1/2

I have heard both the accused including the petitioner present -in-person and Advocate of the petitioner Mr. Maneshinde. In view of the amicable settlement of the dispute between accused no.1 and the petitioner on the one hand and respondent no.2 - Chandrakant P. Rane on the other hand, it is just and proper that the proceedings pending against accused no.1- Sudhir Malhotra and the present petitioner are quashed. Hence, I pass the following order.

i.

The proceedings pending against Accused No.1 - Sudhir Malhotra and Petitioner - Mandhir Satyajit Singh vide C.C. No. 135/PS/2007 arising out of the Crime No. 85 of 2006, registered at Medhwadi Police Station for the offences punishable under section 341 read with section 34 of the Indian Penal Code, before the court of Metropolitan Magistrate, Railway Mobile Court, Andheri, Mumbai, shall stand quashed.

ii.

The bail bonds of Accused No. 1 and the Petitioner shall stand cancelled.

The present writ petition stands disposed of accordingly.
