The applicant was directed to be released on bail in the event of his arrest by an order dated 12/02/2021, when the statement made by the learned counsel for the applicant to the effect that the applicant was ready to deposit an amount of Rs.50,000/- came to be recorded.

The parties are at ad idem that the said amount, so deposited, has been withdrawn by the complainant. M.M.Salgaonkar

By order dated 04/04/2022, the counsel for the applicant undertook to deposit the sum of Rs.40,000/- in two installments and even this amount is deposited in this Court. 3.

The applicant is arraigned as an accused in C.R.No.107 of 2019 registered with Malbar Hill Police Station thereby invoking Sections 406 and 420 read with Section 34 of the IPC. The complaint would make reference to an amount of Rs.13,45,000/- and as far as the present applicant is concerned, it refers to an amount of Rs.1,00,000/-. Out of the said amount, Rs.90,000/- has been deposited in this Court and Rs.50,000/- is permitted to be withdrawn by the complainant under the orders of this Court. I see no hesitancy in allowing withdrawal of the remaining amount of Rs.40,000/- by the complainant. Since, the applicant is already admitted to protection from arrest, the order dated 12/02/2021 is made absolute. The complainant is permitted to withdraw the remaining amount. No further orders are necessary. In view of the disposal of the application, the interim application also stands disposed off.
