This is second application for pre­arrest bail before this Court. The earlier application was rejected vide order dated 26th September 2018. In view of order dated 25th June 2019 passed by regular Court and direction of Hon'ble Chief Justice, the application has been listed before me.

Since the Court was not inclined to entertain and grant relief in the second application for anticipatory bail, learned advocate for applicant, on instructions, seeks permission to withdraw this application. It is, however, submitted that the applicant may be granted time till 14th August 2019 to surrender. 3.

Considering the submission, the application is allowed to be withdrawn. The applicant shall surrender before the Investigating Officer, Bhiwandi City Police Station, on 14th August 2019 at 10 am..

2 of 2 902.ABA.1349.2019.doc It is clarified that in the event applicant prefers application for regular bail after his arrest, the Court shall not be influenced by observations made in order dated 26th September 2018 and order passed in this application, and the Court shall decide the application on its own merits and in accordance with law. 4.

Learned advocate for intervenor undertakes to file his Vakalatnama within three days from today. Application stands disposed off.
