The applicant is seeking anticipatory bail in connection with C. R. No.670 of 2020 registered at Tembhurni Police Station, Dist. Solapur, on 12th December 2020, under Sections 353, 504 and 506 of Indian Penal Code.

Heard Ms. Poonam Bhosale, learned Counsel for the applicant and Ms. Dabholkar, APP for the respondent. 3.

The allegations in the First Information Report are that the first informant was a Circle Officer. The applicant wanted him to correct the entries in the 7/12 Extract. The informant refused and told the applicant that it can be done only after proper inquiry. It is alleged that, thereafter the applicant got angry, he abused the informant and threatened him and he in general caused Manjusha

2 / 2 24 ABA 1129-2020.odt obstruction in the performance of his public duty. On this basis, the F.I.R. is lodged.

At the very outset, the learned APP on telephonic instructions taken from Investigating Officer A.P.I. Mr. Shitole makes a very fair statement that custodial interrogation of the applicant is not necessary. In view of this categorical statement, it appears that the Investigating Agency can investigate into the offence without the applicant'

s custody. In this view of matter, anticipatory bail can be granted to the present applicant. Hence, the following order.

ORDER

1.

In the event of his arrest in connection with C. R. No.670 of 2020 registered at Tembhurni Police Station, Dist. Solapur, the Applicant is directed be released on bail on his furnishing P.R. Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one or two sureties in the like amount.
