This is an application seeking transfer of Suit No. 8431 of 1995 pending before the City Civil Court at Bombay to the Court at Vasai, District -Palghar.

Heard the respective counsel at length.

The learned counsel for the applicant submits that it was mainly on the medical grounds that he was seeking a transfer to Vasai Court and secondly the defendants in the suit are protracting the proceedings without any valid reason and that the matter had been pending for almost 24 years before the City Civil Court at Bombay. varsha

The learned counsel for the appellant upon instructions has further agreed to withdraw the prayer for transfer, in the eventuality that the proceedings before the City Civil Court are expedited. 5.

In view of the above, the learned City Civil Court seized with Suit No. 8431 of 1995 is requested to complete the recording of evidence and the pleading of the parties within one year from today, it shall not be later than November 2020. The learned Court shall not grant unwarranted adjournments to the defendants at any cost. 6.

With these directions, Miscellaneous Application stands disposed of.
