This is an application for modification of order dated 10th December, 2019, passed by the Sessions Court while granting bail to the applicant.

The applicant was arrested in connection with C.R. No. 31 of 2018 investigated by EOW, Unit-II, Crime Branch, Mumbai. While granting bail, the applicant was directed to attend the Digitally signed by RajeP. Aher Date:

2021.03.08 14:56:08 +0530 RajeP.

Aher Investigating Officer of every 3rd Saturday in between 11.00 am. to 5.00 p.m. and cooperate with investigation.

Subsequently investigation was completed and the charge-sheet is filed. The applicant then preferred an application for relaxation of the said condition. By order dated 11th November, 2020, learned Additional Sessions Judge modified the order by directing Sajakali Jamadar

8- APPLN-6-2021.doc the applicant to attend the office of EOW once in month between 10.00 a.m. to 2.00 p.m. on first Sunday of every month and as when required by Investigating Officer, till further order. It is submitted that the applicant is resident of Pune and aged about 69 years and it becomes difficult for him to attend the Police Station. The chargesheet is filed and he attend the trial Court regularly on the date of hearing.

Learned APP submitted that huge amount is involved in the transactions and to keep check on the applicant, the condition to attend is necessary.

In these circumstance, orders passed by the Sessions Court dated 10th December, 2019 and 11th November, 2020 can be modified as follows.

The applicant shall appear before the EOW Unit-II, Crime Branch, Mumbai once in four months on first Saturday of the month between 11:00 a.m. to 2:00 p.m. till further order; 7.

Application stands disposed of accordingly.
