Heard learned Counsel for the parties.

By this application, the applicant has impugned the order dated 23rd September, 2013, passed by the learned Metropolitan Magistrate, 14th Court, Girgaon, Mumbai, issuing process as against the applicant and as such seeks quashing and setting aside of the same and consequently the proceedings i.e. Complaint bearing C.C. No.2964/SS/2016. 3.

Learned Counsel for the applicant states that the applicant was an independent and non-executive Director and was not concerned with the day to day activities of the company - GEI Industrial Systems Limited.

Learned counsel for the Respondent No.2 (original complainant) does not dispute the aforesaid. He states that the complainant i.e. respondent no.2 has no objection for allowing the aforesaid application. 5.

Considering the aforesaid, the Application is allowed in terms of prayer clause 'a' and is accordingly disposed of. 6.

At this stage, learned counsel for the Respondent No.2 requests that the trial be expedited, having regard to the age of the complainant i.e. 65 years. He submits that the trial is pending since 2013 and that there has been no substantial progress in the said case. 7.

Considering the same, the trial of the Respondent No.2 is expedited. The learned Magistrate to dispose of the said case as expeditiously as possible and in any event within 12 months from the date of receipt of this order.
