For the reasons separately recorded, we pass the following order:

ORDER :

(a) We direct the Superintendent of Police, Satara to grant adequate police protection to the third Petitioner and other staff members of the first Petitioner for the purposes of enabling the third Petitioner to take possession of the property sold in public auction and for the purposes of enabling him to hand over possession thereof to the Auction Purchaser;

(b) Within a period of one week from today, the third Petitioner shall inform in writing the date, time and place at which police protection is needed to the Superintendent of Police, Satara;

(c) Within a period of one week from the date on which the intimation is received from the third Petitioner, the amount payable by the first Petitioner in accordance with law shall be determined and communicated to the first or the third Petitioner by the Superintendent of Police, Satara;

(d) On payment of necessary charges, the police protection of male and female constables along with armed constables shall be provided to the third Petitioner;

(e) We direct the State Government to pay costs quantified at Rs.25,000/- to the first Petitioner within a period of six weeks from today;

(f) It will be open for the State Government to recover the said amount of costs from the erring Officers after the payment of the said amount of costs is made to either the first Petitioner or third Petitioner; (g) We direct all the parties concerned including the Superintendent of Police, Satara to act upon an authenticated copy of the operative part of this Judgment and Order;

(h) The Petition is allowed on above terms.
