Heard rival arguments on the application for bail. Present applicant is convicted for the offence punishable under Section 8 of the Protection of Children from Sexual Offences Act, 2012. There is no separate punishment for the offence punishable under Section 354 of IPC. He is sentenced to suffer RI for three years and to pay fine of Rs.1000/-. 2.

After initial custody of about four months, the applicant was granted bail during the trial and now after the conviction also he is on bail. The allegations against the 1 / 2

7.i.APPA.858-15.doc applicant are that during the incident he caught hold of the victim girl, then aged about 17 years and few months. He caught her hands and demanded for sexual favour of giving kiss. The girl resisted him and ran away.

Considering the circumstances and considering that after lodging of the case against him, he has lost his job and was in custody for four months and during the trial was on bail, in the opinion of this Court, the present application can be allowed. Accordingly present application is allowed. The applicant shall be released on same bail as granted by the trial Court with fresh bonds to be executed before the trial Court. ( A. R. JOSHI, J.)
