Dr. F.R. Shaikh, APP for the Respondent - State. ---- CORAM : B. P. DHARMADHIKARI & SMT. SADHANA S. JADHAV, JJ.

DATE : 26th NOVEMBER 2019.

P.C.:

The matter is being considered since long.

Today, Mr. Harbans Singh Gurmukh Singh Ghura has given an affidavit through his Advocate and placed on record no objection to quash the offence insofar as Petitioner No.2 Ms. Jasleen Kaur is concerned. Affidavit is taken on record.

In view of said affidavit, we quash and set aside FIR C.R. No.279 of 2016 dated 15th May 2016 as against Petitioner No.2. Trial pending against her before 65th Metropolitan Magistrate Court, Andheri, Mumbai is also therefore set aside.

Correction carried out pursuant to order dated 19th December 2019.

pmw 2/2 wp-2670.17 spk.odt As far as other two petitioners are concerned, the learned counsel states that let the matter be expedited. We find that Respondent No.2 Mr. Harbans Singh is about 83 years old.

In this situation, 65th M.M. Court, Andheri to attempt to decide the criminal case arising out of charge sheet No.279 of 2016 at the earliest. With these directions, we partly allow the petition and dispose it of.

(SMT. SADHANA S. JADHAV, J.) (B. P. DHARMADHIKARI, J.) Correction carried out pursuant to order dated 19th December 2019.
