IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 2854 OF 2018 Rajas Shirwaikar ....Petitioner.
Vs.
Shyam Bihari Sanghi & Ors.
....Respondents.
Mr. Subhash Chaturvedi for the Petitioner.
Mr. Sudhan Amare for the Respondent No.1 Ms. Veera Shinde APP, for the Respondent-State. CORAM : A. S. GADKARI, J.
DATE : 11th SEPTEMBER, 2018.
P.C.:- The present Petition suffers from multifariousness of cause of action. Four orders are impugned in one Petition. The Petitioner is having remedy of getting NBW cancelled by appearing before the concerned Court and therefore, the Order dated 26th October, 2017 need not be interfered with.
As far as the Order dated 29th January 2018, is concerned, the record prima facie indicates that, on the date of alleged incident, the Petitioner was the Managing Director of the Respondent No.2 Company and therefore, his tendering resignation subsequent thereto has no consequence in the eyes of law.
The Petition being devoid of merits, dismissed in limine. (A.S. GADKARI, J.) 1/1 S S Mashalkar S Mashalkar Date: 2018.09.18 16:53:14 +0530
