DATED : 31st AUGUST, 2021 P.C:- The complainant, by reporting to Niphad police station allege that he is an agriculturist and simultaneously, run a Krushi Seva Kendra at Ugaon. The applicant is alleged to have supplied him the necessary goods and an amount of Rs.15,000/- was due and payable by the complainant to her, is the submission. The incident reported is alleged to have occurred on 13th August 2021 and the time is described as 5.00 p.m when it is alleged that the present applicant along with one Sachin Sandhan barged an entry into his house, with Sachin being armed with wooden rod. They demanded the due amount and when the complainant protested by stating that he cannot repay the amount now, it is
2/3 21 aba 2067-21.doc alleged that Accused no.2 Sachin hit him with wooden rod on his hand.
The aforesaid allegations resulted in C.R.No. 921/21 with Niphad Police Station by invoking Section 452, 504, 506 of the IPC. It is informed that the Accused no.2 is already released on bail.
Taking prima facie view of the accusations faced by the applicant, when she is not attributed any role of assaulting the complainant, and the submission of the learned counsel is to the effect that on the said date of incident, she was not present on the spot and there is evidence in form of CCTV footage to the effect that she was present at her house in Nashik in close proximity at the time when the incident alleged, is said to have occurred. Prima facie, the applicant who claim to be a budding entrepreneur cannot be believed to have been indulged into such an act for the payment of a meager amount. She, therefore, deserve a protection. Hence, the following order :-
O R D E R
(a) Application is allowed.
(b) In the event of her arrest, the Applicant shall be released on bail on furnishing P.R. bond to the extent of Rs.25,000/- with one or two sureties of the like amount.
3/3 21 aba 2067-21.doc (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with facts of case so as to dissuade him from disclosing the facts to Court or any Police Officer and should not tamper with evidence.
(d) The applicant shall report to the concerned police station as and when called for.
