DATE : NOVEMBER 23, 2021 P.C.:- 1] After the matrimonial discord between the parties, respondent-wife initiated proceedings for interim maintenance which came to be allowed vide order impugned dated 28/02/2020 whereby Rs. 12000/- of maintenance is awarded to wife and Rs. 4000/- to the son.

2] Challenge is based on failure of the Court below i.e. Family Court in considering the net income of the petitioner, arguments canvassed and the fact that respondent voluntarily parted the company of the petitioner.

24.7818.21 WP.doc 3] It appears from the order impugned that award of maintenance of Rs. 12000/- to the wife and Rs. 4000/- to the son is based on consideration of net salary of the petitioner which is shown to be Rs. 50,057/- Pay slip of the petitioner taken into account for the said purpose.

As such, no case for indulgence in extraordinary jurisdiction is made out. Petition is rejected.
