In the backdrop of the accusations levelled against the applicant in C.R.No.I-140 of 2018, registered with N.R.I. Police Station, Navi Mumbai, the Investigating Offcer states that a notice under Section 41A of Cr.P.C. was attempted to be served on the applicant, but in his absence, it could not be served. 2.
Learned A.P.P., on instructions from the Investigating Offcer, who is present in the Court, makes a categorical M.M.Salgaonkar
2/2 906 ABA-1953-22.doc statement that the notice shall be served upon the applicant and pursuant to the same, the applicant shall report to the Investigating Offcer, who shall follow the procedure prescribed under Section 41A of Cr.P.C..
In case, if the Investigating Offcer is desirous of effecting arrest, he shall give 72 hours notice to the applicant. 2.
The application stands disposed off.
