Learned counsel for the applicants has submitted that applicants are released on Anticipatory Bail by the learned Sessions Court vide its order dated 25th December 2015 and 24th April 2015 respectively by directing applicants to furnish PB and SB of Rs.15,000/- with one surety in the like amount, which order is duly complied by the applicants.
Tilak 2/2 (912)APPLN-432-16 Learned counsel for the applicants now states that after filing of charge-sheet, learned Magistrate's Court has orally directed applicants to produce the surety, which according to applicants, are not available and applicants are not aware about their whereabouts. It is therefore, prayed that applicants be allowed to furnish cash bail.
Having considering admitted fact of no such order being placed on record which is stated to be orally passed by Magistrate's Court, applicants are granted liberty to file necessary application before the learned Sessions Court. Present Applications are thus rejected with liberty to applicants to approach the Sessions Court.
