Mr.Keluskar, the learned counsel for the appellant, states that the appellant has received the entire amount in question from respondent no.1, and that, the dispute between the avk 1/2

PM-1-APPEAL-860-2011 parties is already amicably settled. It is submitted that the appellant does not wish to prosecute the appeal and has agreed to compound the offence in question.

In view of compounding of offence by and between the parties, the order of acquittal, as passed by the Magistrate, needs to be maintained.

The appeal is dismissed.
