Heard the learned counsel for the applicant, as also the learned Addl. Public Prosecutor for the State. This application is for return of the original Fixed Deposit Receipt which was deposited with the office of this Court.

The present applicant is the appellant in Criminal Appeal No. 1161 of 2013 who was convicted for the offences punishable under the Prevention of Corruption Act. The appeal is already admitted and the applicant is already on bail during the pendency of the appeal.

Vide order dated 12th June 2014 (Coram: A.M. Thipsay, J.), the applicant was allowed to travel abroad to Canada during the period from 15th June 2014 to 31st December 2014. Such permission was granted subject to the applicant furnishing an additonal security in the sum of Rs. 50,000/- by furnishing a surety, or by depositing equivalent cash in the office of the Court. The period for visiting Canada was extended upto 31st March 2015.

In spite of the above permission, for some reason, the applicant could not visit Canada and remained in India. Today, she is present before the Court and as such the Fixed Deposit Receipt in original, copy of which is at exhibit "C" to the present application, is required to be given back to the applicant by the office on her identification.

Accordingly, the office to return the original F.D.R. to the applicant. The criminal application is allowed and disposed of. (A.R. JOSHI, J.)
