The above Criminal PILs seek a direction to register an FIR in terms of the letters and the further complaint letters of the Petitioner to the Respondent Nos. 1 and 2, dates of which are specifically mentioned in each of the Petitions in prayer clause (a) therein. 2.
The learned Counsel for the Petitioner states that the Petitioner is not directly affected and neither any harm or injury is caused to the Petitioner. The Petitioner in the above Criminal PILs seeks to highlight the specific instances of unauthorised construction being carried out on the basis of the alleged forged and fabricated documents. Having regard to the
Mhi 2 CRPILST-21-22-23-17.sxw nature of relief sought in the above Petitions, we do not find any public interest which is sought to be espoused by the above Petitions. We have our own doubts as regards the real motive and intention behind filing of the above Criminal PILs. However, beyond stating as aforesaid, we refrain to make any further comments. We however are of the view that the above Criminal PILs are not maintainable and are required to be accordingly dismissed. If the Petitioner is aggrieved by the non-registration of an FIR, the Petitioner may file appropriate proceedings. The Petitioner may also file appropriate proceedings for seeking directions against the public authorities to take action against the alleged unauthorized construction. (SMT. SADHANA S.JADHAV, J.)
