The sole grievance of the petitioners is though the arguments are heard finally in C.C.No.104/SW/2015 on 14.7.2015, the Learned Metropolitan Magistrate, 5th Court, Dadar, Mumbai, closed the said case for order and adjourned to 8.9.2015. The learned Advocate for the petitioners states that if the order is not passed urgently in the said complaint, accused are likely to abscond.

In above circumstances, in our considered view, this petition can be conveniently disposed of by directing Addl. Chief Metropolitan KJ 1/2

WP2906.15-908.doc Magistrate, 5th Court, Dadar, Mumbai, to dispose of C.C.No.104/SW/15 within a period of two weeks from the date of receipt of the copy of this order.

Ordered accordingly.

It is expressly made clear that we have not gone into the merits of the matter and the Addl. Chief Metropolitan Magistrate, 5th Court, Dadar, Mumbai, shall dispose of the same independently on his own view and without being influenced by any of the observation made in this order. Parties to act on an ordinary copy of this order duly authenticated by the Associate/Sheristedar of this Court.
