1] Learned counsel for the appellant seeks leave to withdraw this appeal, considering that the suit is already fixed for cross examination of plaintiff. His only request is that the suit should be decided by the trial Court, without being influenced by the observations made in the complain.

2] Needless to state that it being interim order, the trial Court will not be influenced by those observations. 3] The appeal, therefore, is disposed off as withdrawn. 4] In view of withdrawal of Appeal itself, Civil Application therein no more survives and the same is disposed off.
