Learned Counsel appearing for the Petitioner and 2nd Respondent prayed for quashing of FIR on the basis of amicable settlement between the parties. However, this Court is not inclined to quash the impugned FIR on the basis of amicable settlement since the alleged offence is punishable under Sections 376, 34 of the Indian Penal Code. The learned Counsel appearing for the Petitioner is called upon to argue the petition on merits, however, learned Counsel for the Petitioner seeks permission to withdraw the Petition.
