Considering the submissions made by the learned counsel for the Appellant following order is passed:

Appeal from Order as well as the Civil Application stands dismissed as withdrawn.
b.
Considering the facts and circumstances of the case, hearing of the Notice of Motion No.1817/2015 is expedited.
c.
This court expects that the Trial Court would dispose of the Notice of Motion No.1817/2015 as early as possible but in any case on or before 31/12/2015.
