By this writ petition the petitioner seeks a direction against the respondent No.1-Chief Officer of the Nagarparishad to enquire into the complaint against the respondent Nos. 2 and 3 for the disqualification of the Respondent No.2 for making illegal construction.

The respondent No.2 was elected as a Nagarsevak in the year 2011 and after his election, he had allegedly made illegal construction on a plot belonging to the respondent No.3- his wife. The petitioner had therefore made a complaint against the respondent Nos.2 and 3 to the Nagarparishad so that the respondent No.2 could be disqualified as a Nagarsevak.

Sudhir Rane 26-WP-10441-2015.doc The cause for filing the writ petition is rendered infructuous due to passage of time. The Respondent No.2 was elected in the year 2011 as a Nagarsevak and his term of office has expired in the year 2016. In this background, the complaint made by the petitioner for disqualification of the respondent No.2 is rendered infructuous.

Hence, we dispose of the writ petition with no order as to costs. The points raised in the writ petition are kept open. (Riyaz I. Chagla J) (Smt. Vasanti A Naik, J)
