P.C:- Learned counsel for the petitioner states that the present Writ Petition assails the order passed by the Family Court granting interim maintenance in favour of respondent wife, pending the Hindu Marriage Petition filed by the petitioner. Learned counsel makes a categorical statement that the said petition is subsequently converted into a 13B Petition and in the said petition, consent terms have been filed by the parties. Learned counsel for the respondent submits that since his client has not contacted him, he is not aware of any of the aforesaid developments.

2/2 902 WP 8889-18.doc The matter being settled between the parties, one of the stipulation is to withdraw all pending proceedings and accordingly, counsel for the petitioner fairly states that the respondent has withdrawn the Criminal Case No.157/2016 pending in the Court of JMFC, Khadki. As a step towards effecting the settlement arrived at between the parties, learned counsel for the petitioner seeks leave of this Court to withdraw the present Writ Petition.
In light of the settlement effected between the parties, liberty as prayed for is granted.
Writ Petition No.8889 of 2018 is dismissed as withdrawn.
